Professional Due Diligence

Part of performing serious and professional due diligence includes validating and verifying professional relationships that are used to establish credibility for a new company with a revolutionary new product such as the Lifewave patch. Since most of Lifewave's credibility is predicated on the results of what they claim to be "Double-Blind Placebo Controlled Studies" at both Troy University and Morehouse College, it is necessary and appropriate to contact both of these prestigious institutions regarding their participation in this important research.

And so we sent the following e-mail to Troy University:

Dear Sirs,

We are hearing a lot about Troy University and the Lifewave Energy Patch on thousands of Multi Level Marketing web sites and Internet e-mail spam. The Lifewave corporate web site has Coach Richard Shaughnessy and Troy University on prominent display:

A double blind placebo controlled study of the LifeWave™ technology as it relates to the improvement of strength endurance in high performance college athletics.

http://www.lifewave.com/studies_shaughnessy.asp

We have a few questions regarding Coach Richard Shaughnessy and Troy University and their participation in these studies, if you don't mind.

Was Coach Richard Shaughnessy paid for his participation in this study? Were any of the athletes paid for their participation?

Does Troy University know that your college, Coach Richard Shaughnessy, and the student athletes at your college are being used on thousands of Internet MLM web sites for promotional purposes?

Did Coach Richard Shaughnessy file a protocol for this study and obtain prior approval of the college's IRB (Institutional Review Board), which by law must approve all experimentation on human subjects? May we see documents that will verify this?

Thank you. We would appreciate a prompt and thorough response that we may include in our report on this Lifewave energy patch study and its affiliation with Troy University.

Troy University responded with this e-mail:

Mr. Burtis,

We have no relationship with Lifewave and have done no research for Lifewave. Our attorney has notified them to cease all references to Troy University or we will peruse legal action. Coach Shaughnessy does not represent Lifewave on behalf of Troy University. I could not find a reference to Troy University on the web site you listed.

Doug Patterson
Senior Vice Chancellor for Administration
Troy University

This was surprising on two levels - first they stated that they had NO relationship with Lifewave and then said they could not find a reference to Troy University on the Lifewave web site. We felt obliged to help in this regard:

Hello, Dr. Patterson-

Thanks you for responding.

You may wish to forward the following web site references to your attorneys.

University and College studies

Formal double-blind placebo controlled studies of LifeWave™ patches have already been done at Troy State University in Alabama and Morehouse College in Atlanta with athletes.

Abstract

The LifeWave™ technology is a new supplement and method for the improvement of athletic performance. LifeWave™ is a means by which an individual may substantially increase their net strength endurance within as quickly as the first use of the product. To evaluate this statement in an unbiased manner, a double blind placebo controlled study was implemented at Troy State University in Troy, Alabama. The principal investigator of this study was Coach Richard Shaughnessy, strength and conditioning coach for the Troy State department of athletics. A standardized test was selected to measure net gains in strength endurance, and in this case the exercise that was performed by all athletes was a 225 lb. flat Bench Press. The baseline data for this test was collected on Thursday June 26, 2003. The comparative data was collected on the following Wednesday July 2, 2003.

Conclusion:

Based on the data collected and the results obtained it was demonstrated that the LifeWave™ technology is a method for the improvement of athletic performance, and more particularly a means by which an individual may increase their net stamina/strength endurance output. The model utilized to evaluate the technology was a double-blind placebo controlled study, with 25 college athletes from the Troy State University football team volunteering to participate in this study.

Formal double-blind placebo controlled studies of LifeWave™ patches have already been done at Troy State University in Alabama and Morehouse College in Atlanta with athletes.

At Troy State University in June-July 2003 both Flat Bench Press (225lb.) and Push-Up studies were done with Coach Richard Shaughnessy as the principal investigator. In the Flat Bench Press study the athletes in the test group who wore the patches had a 43.2% increase in strength performance. In a Push-up study done at Troy State the Troy State strength and endurance coaches found that the college athletes averaged up to 54% more push-ups in their third repetition set while wearing the patches.

Objective:

To quantitatively assess the effectiveness of the LifeWave™ technology in improving the bench press performance of college football athletes during team training.

Main Outcome Measures:

The LifeWave™ technology is a non-invasive patch that demonstrated the ability to improve strength endurance in the majority of athletes that utilized it during a strenuous weight lifting activity.

Conclusion:

Based on the data collected and the results obtained it was demonstrated that the LifeWave™ technology is a method for the improvement of athletic performance, and more particularly a means by which an individual may increase their net stamina/strength endurance output. The model utilized to evaluate the technology was a double-blind placebo controlled study, with 25 college athletes from the  University football team volunteering to participate in this study. In this evaluation of strength endurance involving competitive athletes both baseline and comparative tests were performed prior to any other type of physical activity.

Obviously, Coach Shaughnessy was involving Troy University students in illegal and unauthorized human experimentation without the college's knowledge. Law
requires that such research be reviewed and approved in advance by the university's IRB (Institutional Review Board) and since this was not done, Coach Shaughnessy has exposed the university to serious potential legal issues. Furthermore, what are Coach Shaughnessy's qualifications and credentials for initiating and managing a "formal study" and a "a double blind placebo controlled study" conducted upon Troy University students?

On the Lifewave "Testimonials" web page, it states:

Notable People Who Have Used The Patch Updated 4/05/05

Chuck Ash      Head Trainer, Troy State University
Richard Shaughnessy     Strength & Conditioning Coach, Troy State University

“I have been using LifeWave™ patches for over a year now. When I first started, I could bench press 220 pounds, now I do 330 pounds. Not bad for a 48 year old! I don’t really understand how signal induction works, but I know it works from seeing the results of numerous workouts. I don’t go to the gym without my patches.”

“For over a year I have monitored and recorded results from numerous college athletes and have found that the LifeWave™ patches exceed the product claims. I am currently using the patches to provide strength endurance.”

Does Troy University have any established policies for dealing with such incidents? Are coaches and faculty allowed to involve university students in outside commercial human experimentation, the results of which are then used to promote MLM and network marketing gadgets on thousands of Internet web sites?

Before forwarding this information to the media and state and federal agencies, we would appreciate your input in this regard.

Thank you.

The two primary Lifewave studies - unauthorized by their respective schools, conducted without approval or review by the IRB (Institutional Review Board) as required by law, and disavowed publicly by each institution.

Unauthorized human experimentation on college athletes and students performed by their coaches. How would you feel if you were the parents of a student at one of these schools?

And how much faith should the public have in companies that illegally experiment on college students? And how much credibility or respect do these studies warrant?
